Paxton+Glew Gallery - Terms & Conditions of Sale

Paxton+Glew Gallery is a contemporary art gallery in the heart of Brighton, UK. It's owned in partnership by co-curators Emily Paxton + Pam Glew. We are located at 12 Hannington’s Lane, BN1 1GS within Hanningtons Estate and just minutes from the Brighton Pier and popular Beach front. 

Gallery Opening Hours:

Open daily, except closed on Tuesdays.

Arrangements can be made for a one to one viewing outside of the standard times albeit by appointment only. Please note these hours may change and will be updated on our website accordingly.

This page states the terms and conditions under which you use the www.paxtonglew.com website, at home or in store. Use of the Paxton+Glew gallery website constitutes full agreement with these Terms & Conditions are stated below.

Purchases

You can place your order through our website, or you can contact us directly to speak to a member of staff who will be happy to discuss any purchase with you. You can call on +44 7766110916 or email info@paxtonglew.com.

All of the items sold by the gallery are works of art and are for final sale. If purchasing online, additional photos of pieces purchased are available upon request. Please understand that each item is made by human hands and imperfections may be present.

If purchasing an item that is part of an ongoing exhibition shipping will not be initiated by the gallery until after the close of the exhibition, details of which will be stated on our website or advised upon enquiry. While we will aim to be quick in packaging and safely shipping your newly acquired works of art, please be aware that we are a small operation and shipping can take up to 10 days after the close of each exhibition to prepare.

Any artwork/purchases that are to be collected from the gallery,  must be done so within 21 days of the order being made as storage limitations at the gallery space prevents us from keeping the client's work indefinitely. Items bought, which the customer can not accept delivery for over 14 days of sale,  forfeits the 14 day returns policy.

If the artwork requires shipping, please allow 10 working days for us to process and ship your order.

Shipping

Shipping costs vary considerably depending on the size of the item and distance it has to travel. Shipping quotes will be provided to the buyer upon request. If an item is purchased without first requesting a shipping quote, the shipping fees will be separately invoiced unless agreed otherwise with the gallery. Local buyers are welcome to pick up their purchases in person and thus waive any shipping fees.

We ship artwork worldwide. Various shipping methods and carriers will be used to deliver your artwork to you in the safest and most efficient manner. If you have a preferred shipping carrier you can stipulate this when completing your purchase and we will obtain a quote. Items are generally shipped with insurance which will form part of the shipping costs. The buyer can request the artwork be shipped without insurance but this would be at the buyer’s risk and buyer agrees to absolve the gallery of any recourse due to loss or damage during shipping. We will email confirmation once your order has been shipped.

Occasionally, there will be a location we cannot ship to due to customs regulations and we will inform you if this is the case. All customs duties are the responsibility of the buyer.

If we are unable to despatch your order within 14 days (unless previously stated at time of purchase), we will contact you by e-mail with an estimated despatch date and reasons as to the nature of the delay. If the shipment of your order exceeds 30 days after receipt of payment and the delay is solely on our end, you will be entitled to a full refund for your purchase should you decide to terminate the order.

    1. PAYMENT FOR GOODS & DELIVERY CHARGES

      Paxton+Glew can only supply goods that are ordered online via the website, email, telephone or in person at an event or in the gallery. All payments, including shipping costs, must be paid by credit, debit card, paypal or cash if ordered in person. Paxton+Glew will not accept any other form of payment. All transactions are completed on a secure server.

      Paxton+Glew is not responsible for parcels damaged during shipping.

      Paxton+Glew is not responsible for international duties or taxes. All international duties and taxes in relationship to your order are the responsibility of the purchaser

      Payment is expected in full to mark an item as sold. Full details of your purchase and the gallery bank details will be on your invoice which also serves as proof of provenance.

      Payment is preferred via direct bank transfer. We accept all major credit cards. Payments can be made in the gallery, online or over the phone. The gallery will not store your credit card or banking details. 

      Customer fraud will not be tolerated. Credit card fraud will be reported to and investigated by your financial institution.

        2. DELIVERY TIMES

          Some prints may take a week to produce and then once dispatched are shipped via the 1st Class Recorded ‘Signed For’ service.

            3. PRICES

              Prices are as stated on the website and are subject to change at any time without notice. Any prices quoted for framing are valid for a period of four weeks after which the price may need to be re-quoted and is liable to change.

                4. WARRANTIES

                  Paxton+Glew is unable to provide any warranties in relation to the goods provided over and above its statutory obligation to provide goods of satisfactory quality in accordance with the Sale of Goods Act 1979 as amended by the Sale and Supply of Goods Act 1994.

                    5. AVAILABILITY OF THE WEBSITE & GOODS

                      Paxton+Glew will use all reasonable endeavours to ensure that the website does not have any problems and that the goods displayed are available. However we cannot guarantee the availability of the website or that any goods on the site are in stock or available. In the case of an ordered item becoming out of stock, items will be allocated on a time-ordered basis and a full refund offered to all excess orders.

                        6. TYPOGRAPHICAL ERRORS

                          In the event that a Paxton+Glew item is mistakenly listed at an incorrect price, Paxton+Glew reserves the right to refuse or cancel any orders placed for a product listed at the incorrect price. Paxton+Glew reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Paxton+Glew shall issue a refund in the amount of the incorrect price.

                            7. INTELLECTUAL PROPERTY RIGHTS

                              The rights in the designs and content of this website are owned by Paxton+Glew. They are protected by copyright and other intellectual property rights. You may not copy, reproduce, modify, distribute, display, post or transmit any part of this site without permission. All trademarks, product names and company names or logos featured on this website are the property of their owners.

                                8. RETURNS & EXCHANGE

                                  All products sold at www.paxtonglew.com are verified by us as the genuine article.

                                  Paxton+Glew is confident you will be satisfied with your purchase however if not, returns are accepted within 14 days of receipt. As long as the piece is returned in mint condition within their original packaging alongside original proof of purchase Paxton+Glew is happy to exchange items for a different product, refunds are available at our discretion.

                                  Shipped artworks can be returned to us via post and refunded minus the shipping and packaging cost. Paxton+Glew cannot accept responsibility for loss or damage to returned goods whilst in transit. If you do have to return any item, kindly use a trackable system such as a parcel delivery or courier service.

                                  However, once it has left the UK, Paxton+Glew cannot be held accountable for damages or imperfections in a framed artwork, and our guarantee becomes immediately void.

                                  All orders found to be faulty or not as described will be refunded in full after we have received the item back.  All orders found to be faulty or not as described must be reported to info@paxtonglew.com, with photographs within 14 days of receipt otherwise all guarantees and insurance are expired.  Paxton+Glew will endeavour to replace items after this, however this is not guaranteed.

                                  All refunds will be processed in GBP. We cannot be held accountable to changes in exchange rates.

                                  If you have any problems with your order or wish to cancel/exchange an artworks please contact us to arrange a refund, replacement or exchange. These terms and conditions do not affect your statutory rights as a consumer.

                                  Items bought, which the customer can not accept delivery for over 14 days, or does not collect for over 14 days from the sale, forfeits the 14 day returns policy.

                                    9. PRIVACY & COOKIES POLICY

                                      Paxton+Glew acknowledges that it is bound by the Data Protection Act 1998 and that it will not disclose your details to any third party without your express written consent. As a matter of good practice, we do not share any personal information with anyone and certainly will not sell it to others.                                       Prices and Tax
                                      The price shown for the goods are inclusive of VAT but exclude postage and packing. The price you pay will include VAT on all goods and deliveries within the UK Mainland and the EU.

                                      Deposits
                                      To hold an artwork prior to full and final payment, a deposit of 50% of the total value is required. This will ensure that the artwork is removed from sale for a period of 7 days or another period as agreed in writing with the gallery. After this period, the deposit is non-refundable and will be held as a credit towards your next purchase and the artwork will be re-released for sale.

                                      Confidentiality
                                      Confidential information, including payment details are not stored by the gallery. Customer details are never passed to third parties and are used only in accordance with the Data Protection Act.

                                      Jurisdiction
                                      All purchases will be governed by the laws of England and Wales and both the buyer and the gallery submit to the jurisdiction of the English Courts.

                                      Rights
                                      None of the above Terms and Conditions affects your statutory consumer rights. The gallery reserves the right to amend terms & conditions.                                         10. RIGHT TO ALTER TERMS & CONDITIONS The Paxton+Glew website is constantly updated and these terms and conditions may be updated from time to time. Paxton+Glew reserves the right to change the terms and conditions without notice.

                                         

                                          11. THIRD PARTY LINKS In an attempt to provide increased value to our visitors, Paxton+Glew may link to sites operated by third parties. However, even if the third party is affiliated with Paxton+Glew, Paxton+Glew has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Paxton+Glew. These linked sites are only for your convenience and therefore you access them at your own risk.

                                           

                                            12. VARIATIONS IN ARTWORKS

                                              All artwork descriptions and dimensions listed on the website are intended to be as accurate as possible. However, sizes can vary from print to print. Please do not purchase pre-made frames in advance of receiving and thoroughly checking an artwork.  We cannot be held accountable for any framing costs incurred in any circumstance.
